1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the UnfoldAI website (https://unfoldai.io), the UnfoldAI Visual Studio Code extension (the "Extension"), and any related services, features, or content (collectively, the "Service") provided by Unfold AI ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and the Company.

2. Eligibility

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement and have the legal capacity to enter into these Terms.

3. Account Registration

Certain features of the Service may require you to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.

4. Service Description

UnfoldAI provides AI agent supervision infrastructure for software developers, including but not limited to:

  • Real-time monitoring of AI coding agents within Visual Studio Code
  • Agent Run Reports with risk scoring and change attribution
  • Proactive drift detection and alert notifications
  • MCP (Model Context Protocol) server tools
  • Playbook creation and knowledge base management
  • Terminal capture and command tracking

The Service is provided "as is" and may be modified, updated, or discontinued at any time without prior notice.

5. Subscription Plans and Payment

5.1 Free Tier

The Service offers a free tier with limited features as described on our pricing page. The free tier is provided at no cost and may be modified or discontinued at our discretion.

5.2 Paid Plans

Paid subscription plans ("Pro," "Ultra," or other tiers) provide access to additional features. By subscribing to a paid plan, you agree to:

  • Pay all applicable fees as described at the time of purchase
  • Provide valid payment information
  • Authorize recurring charges for subscription renewals

5.3 Free Trials

We may offer free trial periods for paid plans. At the end of a trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial expires. You will not be charged during the trial period.

5.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. Refunds are provided at our sole discretion and are not guaranteed.

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including all content, features, functionality, software, code, designs, text, graphics, logos, and trademarks, is owned by or licensed to the Company and is protected by copyright, trademark, patent, and other intellectual property laws.

6.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. You may not:

  • Reproduce, distribute, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Sell, rent, sublicense, or transfer your rights to the Service
  • Remove or alter any proprietary notices or labels
  • Use the Service to build a competing product or service

6.3 Your Content

You retain ownership of any content you submit, post, or transmit through the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of operating and improving the Service.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, national, or international law or regulation
  • Infringe upon the intellectual property rights of any third party
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the integrity or performance of the Service
  • Engage in any form of automated data collection (scraping, crawling) without authorization
  • Impersonate any person or entity, or falsely represent your affiliation
  • Harass, abuse, or threaten other users
  • Use the Service for any illegal, fraudulent, or malicious purpose

8. Third-Party Services

The Service may integrate with or link to third-party services, APIs, or platforms (including but not limited to AI model providers, version control systems, and IDE platforms). Your use of such third-party services is subject to their respective terms and policies. We are not responsible for the content, functionality, privacy practices, or availability of any third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICE

The Service provides AI agent supervision and risk scoring as informational tools only. Risk scores, reports, and recommendations should not be relied upon as the sole basis for any development or deployment decisions. You are solely responsible for reviewing and verifying all code changes, regardless of risk assessments provided by the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Any third-party conduct or content on the Service
  • Any bugs, errors, or inaccuracies in the Service
  • Any decisions made based on information provided by the Service

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any content you submit through the Service

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Israel.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
